These Terms of Sale govern every order placed with EL World Performance Nutrition ("EL World", "we", "us" or "our") through elworld.shop. By placing an order you agree to the terms set out below. Please read them carefully before you buy.
Products We Sell
EL World sells food products. Our Blueberry Almond Butter Protein Bars are sold in an 8 pack box, either as a one-time purchase or as a recurring monthly subscription. Product images on the Site are renderings and photographs provided to illustrate the product, and packaging may vary slightly from what is shown. Nutrition information, ingredients and allergens are listed on the product page and on the wrapper, and the wrapper is always the definitive source.
Allergens and Health Information
Our bars contain tree nuts and milk. They are not suitable for anyone with an allergy to those ingredients. Statements made on this Site about our products have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, nursing, taking medication or managing a medical condition, please speak with your doctor before adding any new food product to your routine.
Pricing and Payment
All prices are listed in US dollars and are exclusive of any applicable sales tax, which is calculated and displayed at checkout. Prices are subject to change without notice, but the price shown at the moment you place your order is the price you pay for that order. We accept the payment methods shown at checkout. Your order is only confirmed once payment has been authorized.
Subscriptions
If you choose the monthly subscription option, you authorize us to charge your payment method automatically on a recurring monthly basis at the subscription price shown at checkout, until you cancel. Your subscription renews on the same schedule each month and ships automatically. You may pause, skip, change or cancel your subscription at any time through your account or by emailing support@elworld.shop. Cancellations take effect for the next scheduled order, and orders that have already been processed cannot be cancelled. We will always give you notice before any change to your subscription price.
Order Acceptance and Availability
We reserve the right to refuse or cancel any order, including after an order has been confirmed, for reasons that include product unavailability, errors in pricing or product information, or suspected fraudulent activity. If we cancel an order after you have paid, we will refund you in full. We may also limit the quantity of any product per person, per household or per order.
Returns and Refunds
Because we sell a consumable food product, we cannot accept returns of bars or boxes that have been opened. Your safety and the safety of every other customer depends on that rule.
If your order arrives damaged, incomplete, incorrect, or past its best by date, contact us at support@elworld.shop within 30 days of delivery with your order number and a photo of the issue. We will replace the affected items or refund them in full, whichever you prefer. You will not be asked to ship anything back to us.
Unopened boxes in their original condition may be returned within 30 days of delivery for a refund of the product price. Contact us first at support@elworld.shop to start a return, and we will send you instructions. Returns sent back to us without being requested first cannot be accepted. Original shipping charges are not refundable, and return shipping is the responsibility of the customer unless the return is the result of our error.
Approved refunds are issued to the original payment method. Once we have processed the refund, please allow your bank or card issuer a further five to ten business days to post it to your account.
Cancelling an Order
We pack quickly, so if you need to change or cancel an order please email us at support@elworld.shop as soon as possible with your order number. We will do everything we can, but once an order has been packed and handed to the carrier it can no longer be changed or cancelled.
Limitation of Liability
To the fullest extent permitted by law, EL World Performance Nutrition, its owners, officers, employees, affiliates, agents, contractors, suppliers and service providers shall not be liable for any indirect, incidental, punitive, special or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from or related to your purchase or use of our products or your use of this Site, whether based in contract, tort (including negligence), strict liability or otherwise, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to an order shall not exceed the amount you actually paid for that order.
Nothing in these Terms of Sale excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages, so in those states our liability is limited to the maximum extent permitted by law.
Warranty Disclaimer
Except as expressly stated in these Terms of Sale, our products are provided without any representation, warranty or condition of any kind, either express or implied, including all implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.
Dispute Resolution
If something goes wrong, we want the chance to fix it first. Please contact us at support@elworld.shop and give us thirty days to resolve your concern informally. Most issues are settled quickly this way.
If we cannot resolve the matter informally, you and EL World Performance Nutrition agree that any dispute, claim or controversy arising out of or relating to these Terms of Sale or to any purchase made through the Site shall be resolved by binding individual arbitration administered under the rules of a recognized arbitration body, rather than in court. The arbitration shall take place in the state in which EL World Performance Nutrition is established, or by telephone or video conference where the rules allow it, and the arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.
You and EL World Performance Nutrition each agree that any claim will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding. The arbitrator may not consolidate the claims of more than one person.
Either party may bring an individual claim in small claims court instead of arbitration, provided the claim qualifies and remains in that court. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.
Governing Law
These Terms of Sale and any separate agreements whereby we provide you products shall be governed by and construed in accordance with the laws of the United States and of the state in which EL World Performance Nutrition is established, without regard to its conflict of law provisions.
Severability
If any provision of these Terms of Sale is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed. The remaining provisions stay in full effect.
Changes to These Terms
We may update these Terms of Sale from time to time by posting a revised version on this page. The version in effect at the time you place your order is the version that applies to that order. Please check this page periodically for changes.
